1. General
European Forest Institute (“EFI”) provides and maintains the Genetic Resources Gateway (“Gateway”) as a tool to guide users through the landscape of genetic resources by providing a range of materials and organisations working in the field of genetic resources
By accessing the Gateway, you agree to be bound by these terms and conditions.
EFI may change these terms and conditions at any time without notice to you. By continuing to access the Gateway following any change, you accept and agree to be bound by all changes.
The Gateway, as well as content on the Gateway, may be modified or discontinued without notice.
2. Registration
By registering to the Gateway you can deposit metadata about your organization and its resources in relation with Genetic Resources.
To register you must provide the following information:
Your name
The organization you represent
Your affiliation with the organization you represent
By logging on to your Gateway profile you can update this information or delete your profile at any time.
3. Use of Gateway
By submitting metadata you agree that the metadata will be published on the Gateway and made accessible under the cc-by 4.0 license.
The submitted metadata is subject to the review of the Genetic Resources Gateway publishing team before publication on the Gateway.
The metadata can be rejected in case of non-compliance with Criteria for content approval (see page ‘how it works’).
You are responsible for the update of the metadata you submit. You will be informed in case of automatic detection of broken links and you will be requested to update them. The broken links will be deleted if not updated within the deadline provided
You are solely responsible for the searches you carry out, as well as for the interpretation and use you make of the results.
EFI does not guarantee the quality and the completeness of the data on line nor that the web site it totally up to date.
Access to the Gateway can be interrupted or discontinued at any moment and without prior warning.
You may not post spam, access the Gateway or collect the content of other users or information using automated means, upload viruses or other malicious code, solicit login information or access an account belonging to someone else, use the Gateway to do anything unlawful, misleading, malicious, offensive, or discriminatory, do anything that could disable, overburden (e.g. impair the proper working of the Gateway), or facilitate or encourage any violations of these terms and conditions.
4. Intellectual Property Rights
You may not use the Gateway or content on the Gateway in any way that infringes the intellectual property rights of EFI or any other party. You therefore have to be aware of copyrights, trademarks, patents and other proprietary rights and laws that may apply to specific material within the Gateway.
By adding, uploading, submitting, distributing, posting to, creating, or making available User content through any similar action you grant EFI a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use that User content, for the duration of intellectual property rights protection. You represent and warrant that your actions don’t infringe upon the rights of any third parties.
5. Limitation of liability
The use of the Gateway and the use of information received through the Gateway is at your own risk.
The information from or through the Gateway are provided "As-is," "As available," without warranties, express or implied (including but not limited accuracy, availability, completeness, fitness for purpose, non-infringement or reliability).
The information and services may contain bugs, errors, problems or other limitations.
EFI has no liability whatsoever for use of any information or service provided through the Gateway. In particular, but not as a limitation thereof, EFI is not liable for any direct, indirect, special, incidental or consequential damages (including damages for loss of business, loss of profits, litigation, or the like).
You confirm and agree that EFI is not liable for any conduct of any user of the Gateway.
6. Indemnification
You agree to indemnify EFI from and against any and all actions, claims, losses, damages, liabilities and expenses arising from your use of the Gateway.
7. Privileges and immunities
Nothing in these terms and conditions is to be interpreted as a waiver of any privileges or immunities accorded to EFI by its constituent documents or international law.
EFI may process your personal information for the following purposes:
For regular administrative check in the Gateway and communication with you to ensure the full functioning of the platform
To ensure that the content and organisation added on the Gateway are associated to a real person that has full rights to share the material.
For notifications and automatically generated emails regarding the update of the content you are responsible for.
For sharing information added to the Gateway with publishers
Reassignment of content added by other registered users belonging to your organisation.
For statistical analysis of the usage of the Gateway (e.g. number of contents submitted by each user).
To ensure the continuous update and enrichment of the Gateway, and therefore invite inactive users with an account to add new content on the Gateway.
EFI may furthermore use all this personal information if needed to comply with applicable laws and regulations.
Your personal information may be transferred by EFI to third parties for the above-mentioned purposes.
The ground for processing is that you have provided your consent.
You can withdraw your consent or delete your profile by contacting genresbridge@efi.int
The personal information provided by you or collected by EFI will not be kept for longer than is needed to fulfil the above stated purposes.
