1. Agreement

European Forest Institute (“EFI”) provides and maintains the Genetic Resources Gateway  (“Website”) as a tool to guide users through the landscape of genetic resources by providing a range of materials and organisations working in the field of genetic resources.

By accessing the Website, you agree to be bound by these terms and conditions. 

EFI may change these terms and conditions at any time without notice to you. By continuing to access the Website following any change, you accept and agree to be bound by all changes. 

The Website, as well as content on the Website, may be modified or discontinued without notice. 

 

2. Content 

You may not post spam, access the Website or collect the content of other users or information using automated means, upload viruses or other malicious code, solicit login information or access an account belonging to someone else, use the Website to do anything unlawful, misleading, malicious, offensive, or discriminatory, do anything that could disable, overburden (e.g. impair the proper working of the Website), or facilitate or encourage any violations of these terms and conditions.

 

3. Intellectual Property Rights

You may not use the Website or content on the Website in any way that infringes the intellectual property rights of EFI or any other party. You therefore have to be aware of copyrights, trademarks, patents and other proprietary rights and laws that may apply to specific material within the Website.

By adding, uploading, submitting, distributing, posting to, creating, or making available User content through any similar action you grant EFI a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use that User content, for the duration of intellectual property rights protection. You represent and warrant that your actions don’t infringe upon the rights of any third parties. 

 

4. Third party links 

The Website may contain links and references to third-party websites. These are provided for your convenience and interest. For EFI, this implies neither responsibility for, nor approval of, information contained in these websites.

 

5. Limitation of liability

The use of the Website and the use of information received through the Website is at your own risk. 

The information from or through the Website are provided "As-is," "As available," without warranties, express or implied (including but not limited accuracy, availability, completeness, fitness for purpose, non-infringement or reliability). 

EFI does not guarantee the quality and the completeness of the data on line nor that the web site it totally up to date. 

Access to the Website can be interrupted at any moment and without prior warning. 

You are solely responsible for the searches you carry out, as well as for the interpretation and use you make of the results. 

The information and services may contain bugs, errors, problems or other limitations. 

EFI has no liability whatsoever for use of any information or service provided through the Website. In particular, but not as a limitation thereof, EFI is not liable for any direct, indirect, special, incidental or consequential damages (including damages for loss of business, loss of profits, litigation, or the like).

You confirm and agree that EFI is not liable for any conduct of any user of the Website.

 

6. Indemnification 

You agree to indemnify EFI from and against any and all actions, claims, losses, damages, liabilities and expenses arising from your use of the Website. 

 

7. Privileges and immunities 

Nothing in these terms and conditions is to be interpreted as a waiver of any privileges or immunities accorded to EFI by its constituent documents or international law.

Personal data processing notice for external users 

When using the “suggest changes” button, you will be asked to provide your name and email address. This personal data will be shared with the owner of the content you are suggesting changes for. In this way, the communication between you (the user) and the owner of the content (editor) is facilitated. EFI may further process your personal data provided when suggesting changes to a published content for the following purposes: 

  • For regular administrative check of the Gateway, and communication with you, to ensure the full functioning of the platform

  • To track the association of the comment with a real person

  • To facilitate the communication between the editor (owner of the content) and the user (suggesting changes). The name and email address of the external user will be visible only to the editor to allow a follow-up. The data will be kept only as long as it is needed but, in any cases, no longer than five years (until the end of the project) unless you withdraw your consent (contacting genresbridge@efi.int)

  • For statistical analysis and usage of the Gateway

EFI may furthermore use all this personal information if needed to comply with applicable laws and regulations. EFI will not use the personal information for marketing purposes.

Your personal information may be transferred by EFI to third parties for the above-mentioned purposes.

The ground for processing is that you have provided your consent. 

You can withdraw your consent by contacting genresbridge@efi.int 

The personal information provided by you or collected by EFI will not be kept for longer than is needed to fulfil the above stated purposes.
